Terms of Service
1. General
For the business relationship between the customer and the dive shop, the general terms and conditions apply in the version valid at the time of the conclusion of the contract. The author reserves the right not to be responsible for the topicality, completeness, correctness or quality of the information displayed on our websites. All offers are non-binding. We reserve the right to make changes and additions at any time without prior notice. Liability claims against the author caused by the use of incorrect or incomplete information or misprints are excluded.
2.) contract conclusion
The contract comes about after ordering of the customer with dispatch of the order confirmation by Sidemountshop. The confirmation will be sent electronically as an e-mail. In the case of telephone order acceptance, the order confirmation may in exceptional cases also be made by telephone. For other forms of order the acceptance of the order may be made by the execution of the delivery.
The customer is responsible for the full and correct delivery address when placing an order electronically. An electronic contract is not concluded if the customer can not be reached with the order confirmation.
A minimum order value does not exist.
Place of fulfillment is the seat of Sidemountshop.
3.) Payment
The prices stated at the time of ordering apply. Special prices are only valid after special agreement.
The purchase price is due upon delivery of the object of purchase and handing over or sending the invoice for payment.
The buyer can offset counterclaims only if the counterclaim of the buyer is undisputed or a legally valid title exists. A right of retention can only be asserted by the buyer insofar as it is based on claims arising from the purchase contract.
4.) Delivery and delivery time
Delivery date and delivery times, which can be agreed as binding or non-binding, must be stated in writing.
The shipping preferably takes place by Deutsche Post AG possibly also by other parcel services. All standard products are delivered as fast as possible. In case of delivery delays, the customer will be informed immediately.
5.) Shipping costs
For packaging and shipping the prices quoted in the order process are calculated. For partial deliveries, the shipping costs are calculated as if a total delivery had been made.
6.) Retention of title
The object of purchase remains the property of Sidemountshop until full settlement of the claim. This also applies to ongoing business relationships.
In case of default of the buyer Sidemountshop can withdraw from the purchase contract.
As long as the reservation of title exists, the buyer may neither dispose of the object of purchase nor grant third parties a contract.

For material defects the legal regulations apply.

Excluded from the recall are goods that were made especially for you or were ordered in larger quantities especially for you. If goods are specially ordered or made for you, they will be communicated to you in the order confirmation or before ordering by phone or email.
Consequences of the cancellation
If you withdraw from this Agreement, we have selected all payments we have received from you, including delivery charges (except for the additional costs arising from your choosing a different delivery method than the standard delivery offered by us have to repay immediately and at the latest within fourteen days from the date on which the notification of your revocation of this contract has reached us. For this repayment, we use the same means of payment that you used in the original transaction, unless otherwise agreed with you; In no case will you be charged for this repayment fees. - for the supply of goods, if, due to their nature, they were inseparably mixed with other goods after delivery,
- for the supply of alcoholic beverages, the price of which was agreed at the time of the conclusion of the contract, but which can not be delivered until 30 days after the conclusion of the contract and whose actual value depends on fluctuations in the market over which the entrepreneur has no influence,
- for the delivery of sound or video recordings or computer software in a sealed package, when the seal has been removed after delivery
- for the delivery of newspapers, magazines or magazines with the exception of subscription contracts.
End of revocation
10.) Addition
Should one or more regulations of these terms and conditions be ineffective, this does not entail the ineffectiveness of the entire contract. The ineffective regulation will be replaced by the pertinent statutory regulation. The validity of the UN sales law is excluded, German law applies.
11.) Notes acc. § 18 BattG Batteriegestz
Batteries must not be disposed of with normal household waste. As an end user, you are legally obliged to return / properly dispose of used batteries.
You may return the batteries free of charge after use at the point of sale or in the immediate vicinity (for example, at the collection points in the shops or at municipal collection points). You can also return the used batteries to us free of charge or send them back to us by post (Sidemountshop - Thomas Swiglowski, Raßmannsdorfer Str. 4, 15848 Beeskow).
Contaminated batteries are marked with the following symbol consisting of a crossed-out wheeled bin and the chemical symbol of the heavy metal that determines its classification as pollutant. Cd stands for cadmium, Pb for lead and Hg for mercury.
